Gay News Corner- Tax Time!

Today is April 15th, which means we file and pay our taxes in the U. S. Not having our relationships legally recognized can create many headaches for gay couples. Check out this article from the Advocate-


Tax Time for Gay Couples Means Complications, Higher Bills

For gay couples, the April 15 tax filing deadline can be a reminder of the disparities they face, even in a nation that is becoming more accepting of same-sex couples.

Gay couples often pay higher taxes because they don't get the federal tax benefits that go with marriage. And for couples in state-sanctioned domestic partnerships, civil unions, or same-sex marriages, filing federal income taxes can involve doing three sets of paperwork instead of one.

''It's a significant financial disability,'' said Beth Asaro, who last year entered into one of New Jersey's first legally recognized civil unions.

While the debate over government recognition of gay marriage is a political hot-button with arguments about morality, civil rights, and tradition, the tax issue is a mostly practical one for thousands of same-sex couples.

Most states don't recognize same-sex unions in any way. Only in Massachusetts can gay couples legally marry. Since 1997, nine other states and Washington D.C. started offering civil unions or domestic partnerships that give some or all the legal protections of marriage.

Those protections include allowing gay couples to file state taxes jointly -- potentially saving them money. But they can also make tax filing more complicated for the couples.

That's because the state protections do not help with federal taxes. Under the 1996 Defense of Marriage Act, the government recognizes marriage only between a man and a woman.

''You're running one household,'' said John Traier, a partner in the Butler, N.J., accounting firm Hammond & Traier. ''But the federal government and a lot of states treat them as two households.''

The same is true for unmarried straight couples who are living together.

There are two main effects of the different treatment under federal law.

One is the tax rate. Take two couples where one partner has a taxable income of $20,000 and the other makes $40,000. If they can file their federal taxes jointly, the tax bill would be $8,217.50. Filing separately, the combined bill would be $9,032.50 -- more than $800 higher.

Another disparity comes with the federal government's treatment of employer-provided health insurance, which also affects unmarried heterosexual couples.

For example, Dan Jessup is a project manager at JPMorgan Chase in Indiana. His partner, Bob Chenoweth, is self-employed, running two businesses out of the couple's Mooresville, Ind., home. So Chenoweth gets health insurance through Chase.

But Jessup is required to count the company's cost of his partner's benefits as additional income for tax purposes.

State and federal taxes on those benefits cost about $1,800 per year, Jessup said.

''I certainly think about it every payday,'' when the extra withholding is taken from his paycheck, he said. ''If you think about 10 years, $18,000 is a lot of money. That could buy me a pretty nice car.''

The tax on benefits for domestic partners also applies to employers. Companies including Chase are endorsing the Human Rights Campaign's push for a bill that would end the tax on health plan benefits for people who are neither the spouse nor legal dependent of the employee. Versions of the bill have been introduced in Congress in the last three sessions, but have never moved out of committee.

A government analysis estimated the bill would cost about $10 billion in lost federal tax revenue over 10 years. Advocates for the bill say it would create savings elsewhere, including reducing the Medicaid rolls.

Ryan Ellis, the tax policy director for Americans for Tax Reform, said his group supports the concept, but not the specific language of the bill, because it does not propose increasing how much domestic partners could put into health savings accounts.

It's not just the higher bills that can be frustrating for same-sex taxpayers; it's also the process of filing taxes, particularly in states that offer some joint benefits to gay couples.

''I don't want to say it's chaotic, but it's very difficult for a lot of reasons,'' said Traier, the accountant who is in a civil union partnership himself.

In New Jersey and the other states where same-sex unions are formally recognized, couples can file their state taxes jointly, but they must file their federal tax returns as individuals.

That means doing income calculations twice. Many tax programs such as Intuit's TurboTax are set up to deal with that extra math.

But there are other issues even up-to-date software might not solve.

These issues also affect unmarried straight couples.

For instance, couples with children must decide which partner gets to claim them as dependents for tax purposes on federal returns and returns in states that don't recognize same-sex unions. Similarly, couples who own homes together have to sort out how much of the mortgage interest payments each partner gets to use as a deduction, said Lara Schwartz, the Human Rights Campaign legal director.

The pics of Reese and kids in Ojai and Reese shopping alone in WeHo are both said to be from yesterday. She's wearing different clothes in them. Doesn't look too happy in either set. The blurb on the Buzz Foto pix is interesting-

We bring you these super-urgent fotos of Reese Witherspoon shopping today in West Hollywood! Fresh off the presses! We caught Reese picking up a few items at Paul Smith clothing boutique on Melrose Boulevard. Funny thing is that she was shopping all alone - no children, and no Jake Gyllenhaal. Maybe he volunteered to take the kids to the park today so mommy could have a day off. Those assumption, though, are only in our dreams - we know that Reese and Jake have declared it “break” time but the couple was just to cute to not work. Take him and run, Reese!

I don't even do my own taxes and reading this post made my head explode. I'm glad I had that beautiful picture from Mrs. Wicked to return me to a calm state. There was a period when my gf was on my health insurance, and it was maddening to have to pay taxes on it. At least that employer offered the option, my current one doesn't, but luckily it is not an issue right now. And of course I don't live in a state like Mass. Luckily we have a gay accountant with reasonable rates that we both adore.

The "break" comment can mean so many things, so I'm going to wait before commenting on that one. Regarding the Ojai pictures, wouldn't they have more likely been taken on the weekend, when the kids don't have school.

The one thing that leapt out at me in the shopping sighting is that it was in WeHo, a place Jake seems to be banished from. Gotta wonder if she did it to rub his face in it.

they're starting to film at the state house this week and jake gyllenhaal was at the strom gym the other day and some of my sorority sister got to meet him but he wanted to lay low so they didn't get a picture with him but he said that could be sketchy and take one of him.

Destiny, I did both the Mrs.' and my taxes this year- two sets of federal and state. Ugh! Figuring out who should claim the house so we get the maximum money back. It's a real pain in the keister, as Austin would say. And I hate the argument that unmarried hetero couples are in the same boat. Unmarried hetero couples can switch to the married boat if they don't like it. We can't.

Tom texted me at 5 am about his question being published by Ted. He thinks he's all that, of course! Said a couple interesting things. He said he sent that question in quite a while ago. And he did not tell Ted to get it up, dude! He told Ted to give it up, dude! Ted changed it.

SC has been working hard to bring more film revenue to their state. They were in the running with CT for Nailed.

Why Columbia? Less expensive, less crowded and great weather. But boo - no cherry blossoms for them.

But how would real congressman would react to such a satirical portrayal of them being filmed in DC? I don't think they would have welcomed the crew with open arms.

Great post/music today. Of course I had to Google the band and listen to the album on Amazon. The fast tracks on the Untrue album are my favorite. The slow ones kind of remind me of Zero 7. I can’t wait to get these into my Ipod. Thanks Wicked.

The reaction to the Jake was rude sighting on Gyllenbabble is quite illuminating. They had a few reasons why he might have been rude-

1)he wasn't really rude
2)people were bugging him
3)he was in character
4)he was missing Reese!

Why do I bring this up? Because it shows how far people will go mentally to preserve their view of someone. Jake must be nice all the time, he can never be rude. Let's face it, we've all been rude, of course Jake has too. But to some of his fans he must be perfect all the time. Even if the explanations are ridiculous, they will continue to generate them and believe them. Whenever you wonder how anyone could believe this fauxmance, or how anyone could think these two are not doing this for the publicity, think of this incident.

my friend works at marble slab and said jake came in to get some ice cream.

i go to the strom to work out religiously, several times a week, but i havent been this week because of all my final papers and such im working on.

When I saw the letter I had written to Ted at 4:30am this morning I didnt know whether to laugh or have a heart attack. Ted is very bad. It was "give it up". I wrote that letter to Ted when he seemed to be a little hiatus from TT/Jake after Heath's death. It was meant to say that no matter what other Bi's he writes everyone still wants and loves TT/Jake.

I had to wait till 5am to txt W. I know I will probably be in big trouble with the Mrs. but I just couldn't wait. That is my fourth letter. It is so much fun that he has published them. They are all a gift to my friends at OMG.


What the heck did Ted mean about reese? W. told me reese would be in today's column since Ted had her name on yesterdays list.


There is no way reeke is over yet. The hiatus has to mean that Jake will be in SC filming for the next couple months. I do expect to see reese there. I will be shocked if she does not make an apperance.

Im glad Jake got to get some ice creme in SC. btw did you know Jake has a bad reputation with most all LA ice creme places? They can't stand him. some wont even let him go inside their shops, seriously because he's cost them a lot of money. Im surprised the ice creme parlors in SC havent heard about it yet but if he's gonna be there for 10 weeks it might happen there too sooner or later. It all started a few years ago when he went into a ice creme shop and everything got ruined and now no ice creme vendor in LA will let him near thier product or in thier store because his hot makes it all melt and it costs them a bunch of money to replace everything.

Jake: get your ice creme now in SC while you still can!! :)

I don't even do my own taxes and reading this post made my head explode. I'm glad I had that beautiful picture from Mrs. Wicked to return me to a calm state.

I have to say though that just like Destiny I no longer do my own taxes. I found myself a great accountant a couple of years ago who did them for me and found some deductions I would never have dreamt of claiming before; and all this for a very reasonable fee. So for me, spring means fighting with the dogs to keep them from playing in mud and cleaning up the garden but certainly not doing taxes!

Thanks so much for these great news about Luke Honesty! I LOVE Scotty in Brothers and Sisters and I'm so glad he's decided to come out! I got the first season of B&S on DVD and I'll buy the second season as soon as it's out. I just had the time to speed-read the article you linked and I haven't had time to check if we'll get a third season of B&S (I heard there were problems after the writers' strike). If so, I HOPE Scotty's character will have plenty of airtime! :)

Interesting chat with author Lisa Diamond about a book she wrote called Sexual Fluidity. Her theory is that women are more sexually fluid than men.

Haven't had time to read that discussion yet but that made me think about one thing I've personnaly experienced in my life with men and it's that they certainly have an easier time compartimentalizing each an every part of their life - be it domestic, professional, emotional, sexual – than women. Does this extraordinary (IMO) capacity to "separate & isolate" different aspects of their psyche play a role in their "lack" of fluidity when it comes to sex? Hmmm, I think I have to read what that Lisa Diamond has to say on that topic!

That Burial song reminds me a bit of one of our very own & beloved singer named Corneille, whom I absolutely love. ;)

This may be out there, but I thought Ted with his sarcasm meant that the "byline", who an article is written by, would be Toothy, who to Ted, is the quintessential closted actor, whoever he may be. He calls the L.A. Times a "copycat" because Ted has written first about both botoxed actresses and closted actors. All yesterday's news, to Ted. :)
